my-iphone.com provides users with the free email service @my-iPhone subject to the terms set in this service agreement. my-iPhone.com may change this Service Agreement at any time, with or without prior notification.
1. REGISTRATION DATAYou agree to provide my-iPhone.com with complete and accurate registration information as prompted and to inform my-iPhone.com of any change to keep it current. You agree to remain solely responsible for all such information including your choice of email address.
2. SUBSCRIBER CONDUCTYou are solely responsible for the content you transmit through @my-iPhone, and acknowledge that it acts as a passive conduit for the transmission of your data.
You warrant that you will not:
• send unsolicited email directed to people not personally known to you, including but not limited to junk mail, chain letters, or other unsolicited bulk email, commercial or otherwise;
• transmit content that is unlawful, harmful, abusive, threatening, defamatory, invasive, vulgar, obscene, or that contains viruses or other similar harmful programming;
• impersonate any person or entity, including, but not limited to, a my-iPhone.com representative, or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
• engage in attempts of fraud or forgery, including, but not limited to, the use of fraudulent credit cards or other falsified means of payment, forging message headers, or manipulating identifiers in order to alter or disguise the origin of any transmitted content;
• interfere with or disrupt the @my-iPhone service or servers or networks connected to it;
• infringe on any third party's intellectual property rights or proprietary rights, or rights of publicity or privacy.
You will obey any requirements, procedures, policies or regulations of @my-iPhone or connected services, and observe and comply with any usage restriction set forth by administrators, with regards to content, storage space, traffic, bandwidth, and other conditions.
In order to access the @my-iPhone email services, you will be asked to sign in with an email address and password, which we refer to as your credentials. As part of creating your credentials, you may also be requested to provide details, which we use to help verify your identity and assist in managing your account such as resetting your password. We may ask you to provide personal information, such as your name and email address and may also collect demographic information, such as your country of residence and age.
We may use your personal information to send certain mandatory service communications such as welcome letters, information on technical service issues, and security announcements. We may also send periodic member letters that are considered part of the service.
We consider your use of the service to be private. However, we may access or disclose information about you, your account and/or the content of your communications, in order to:
• comply with the law or legal process served on us;
• enforce and investigate potential violations of this contract; including use of this service to participate in, or facilitate, activities that violate the law;
• protect the rights, property, or safety of @my-iPhone, its employees, its customers or the public. You consent to the access and disclosures outlined in this section.
We may use technology or other means to protect the service, protect our customers, or stop you from breaching this contract. These means may include, for example, filtering to stop spam or increase security. These means may hinder or break your use of the service.
4. RULES RELATING TO MINORSIf you are under the age of 13 you may not subscribe to @my-iPhone.
5. PERSONAL USEYour right to use @my-iPhone is personal to you. You agree not to resell your @my-iPhone email address and service. Please guard your account password, as you are liable for all uses of your account, including any unauthorised use.
6. INTERNET ACCESS SERVICEThe @my-iPhone service does not include Internet access, and you are responsible for paying the all fees charged by your Internet access providers.
7. INDEMNIFICATIONYou will indemnify and hold harmless my-iPhone.com, their employees, directors, officers, agents, and their successors and assigns from any damages and expenses relating to the use of your account.
8. DISCLAIMER OF WARRANTIESYou use @my-iPhone at your sole risk. @my-iPhone is provided on an "as is" and "as available" basis. my-iPhone.com expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
my-iPhone.com does not make any warranty that @my-iPhone will meet your requirements, or that the services will be uninterrupted, timely, secure, or error-free; nor does my-iPhone.com make any warranty that the results that you may obtain through @my-iPhone meet your needs or that they will correct any software defects. my-iPhone.com does not make any warranty regarding any goods or services purchased or obtained, or any transactions entered into through @my-iPhone.
Any material and/or data you download or otherwise obtain through @my-iPhone comes at your own discretion and risk. You will be solely responsible for any damage to your computer systems or loss of data. No advice or information, whether oral or written, which you obtain from my-iPhone.com or through @my-iPhone will create any warranty not expressly stated in the Service Agreement.
9. LIMITATION OF LIABILITYmy-iPhone.com will not be liable for any indirect, incidental, special, or consequential damages or for interrupted communications, lost data or lost profits arising out of or in connection with the Service Agreement, even if my-iPhone.com has been advised of the possibility of damages.
10. TERMINATIONYou may terminate your account at any time. To terminate your account please contact my-iPhone.com to obtain information on cancelling your @my-iPhone email account.
Failure to comply with the Service Agreement may result in the termination of your account, with or without notice, upon which incoming email will be returned as "undeliverable".
my-iPhone.com may cancel the @my-iPhone service at any time, with or without notice.
11. MODIFICATIONSmy-iPhone.com may at any time augment or enhance the current service with new features, with or without prior notification.
12. MISCELLANEOUSThe Service Agreement is governed by the laws of the United Kingdom without giving effect to principles of conflict of laws. If any provision of the Service Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. my-iPhone.com's failure to act with respect to a breach of the Service Agrement by you or others does not waive my-iPhone.com's right to act with respect to subsequent or similar breaches. The Service Agreement sets forth the entire agreement between you and my-iPhone.com, and supersedes any prior agreements pertaining to the subject matter contained herein.
13. VIOLATIONSPlease Contact Us to report any violations of the Service Agreement.
